in proceedings, we have many types of claims; when a litigant files a claim/case/action/lawsuit, then such litigant is called, inter alia (a Plaintiff), however, the sued (accused) litigant is called (a Defendant); THEN...
If the said Defendant, in the course of the same proceedings, wanted to file a case against the Plaintiff, in this case, the Defendant shall be named "Counter Plaintiff" and the Plaintiff shall be named after "Counter Defendant", in addition, the new case shall be named after "Counterclaim / Counter Action / Counter Case" and the old claim, first filed, shall be named after "Original claim / action / case"
In other words, we have
- Tom (Plaintiff) vs Stephen (Defendant) (Dispute here is called "Action / Claim / Case ...")
- Stephen has an issue to report against Tom before the court, thus he petitioned to file a case, (This case will be called a Counterclaim) and Stephen, in this case, will have 2 names (Defendant in the Original Action and Counter Plaintiff in the Counter Claim. Tom will have two names as well, Plaintiff in the Original Action and Counter Defendant in the Counterclaim)
