(1) With the entry into force of Regulation (EC) No 631/2004 of the European Parliament and of the Council of 31 March 2004 amending Council Regulation (EEC) No 1408/71 and Council Regulation (EEC) No 574/ 72, in respect of the alignment of rights and the simplification of procedures, procedures for obtaining access to sickness benefits in kind during a temporary stay in another Member State were simplified. It is appropriate to extend the simplified procedures to the provisions on benefits in respect of accidents at work and occupational diseases contained in Regulations (EEC) No 1408/71 and (EEC) No 574/72.
(2) In order to take account of changes in the legislation of certain Member States, in particular in the new Member States since the end of accession negotiations, the Annexes to Regulation (EEC) No 1408/71 need to be adapted.
(3) Regulations (EEC) No 1408/71 and (EEC) No 574/72 should therefore be amended accordingly.
(4) In order to ensure legal certainty and to protect the legitimate expectations of persons affected, it is necessary to provide that certain provisions modifying Annex III to Regulation (EEC) No 1408/71 take effect retroactively from 1 May 2004.
(5) The Treaty does not provide powers other than those under Article 308 to take appropriate measures within the field of social security for persons other than employed persons,

Regulation (EEC) No 574/72 is hereby amended as follows:
1. in Article 60, paragraphs 5 and 6 shall be deleted;
2. Article 62 shall be replaced by the following:
‘Article 62
Benefits in kind in the case of a stay in a Member State other than the competent State
1. In order to receive benefits in kind under Article 55 (1)(a)(i) of the Regulation, an employed or self-employed person shall submit to the care provider a document issued by the competent institution certifying that he is entitled to benefits in kind. That document shall be drawn up in accordance with Article 2. If the person concerned is not able to submit that document, he shall contact the institution of the place of stay which shall request from the competent institution a certified statement testifying that the person concerned is entitled to benefits in kind.
A document issued by the competent institution for entitlement to benefits in accordance with Article 55(1) (a)(i) of the Regulation, in each individual case concerned, shall have the same effect with regard to the care provider as national evidence of the entitlements of the persons insured with the institution of the place of stay.
2. Article 60(9) of the implementing Regulation shall apply mutatis mutandis.’

1. Yerel Yönetim Türleri İtibarı İle Seçimle Oluşan Organlar
1.1. Türk kamu yönetimi sistemi içinde merkezi idarenin dışında yerinden yönetim ilkesine göre yer alan yerel yönetimler, belediyeler, il özel idareleri ve köylerdir. İl ve ilçe statüsünde olan yerlerde yasal bir zorunluluk olarak belediye kurulur. İlçe statüsünde olmamasına rağmen nüfusu 5.000’in üzerinde olan yerlerde, genellikle köyler ve köy altı yerleşimler, yerel halkın isteği ve gerekli yasal prosedür tamamlanarak belediye kurulabilir. Nüfusu 750.000 ve üzerinde olan illerde iki kademeli belediye modeli vardır. Üst kademede genel yetkili büyükşehir belediyesi, alt kademede ise büyükşehir belediyesi sınırları içinde kalan alanda daha yerel nitelikli kamu hizmetlerini sunmak üzere sorumluluk sahibi olan ilçe belediyeleri. İl sınırlarının tamamını kapsayan, il sınırları içindeki belediye ve özellikle köylere yönelik yasalarla öngörülen hizmetleri sağlamakla görevli yerel yönetim birimi olan il özel idareleri Türkiye’deki yerel yönetimlerin diğer türünü oluşturur. 1. Bodies Formed by Elections by Types of Local Government
1.1. The Turkish public administration system includes municipalities, special provincial administrations and villages as local governments established on the basis of decentralization, outside the central government. It is legally mandatory to establish municipalities at places with the status of a province or a district. It is possible to establish a municipality at a location which does not have the status of district but has a population of more than 5,000 upon the request of the local residents and after completing the required legal procedures; such locations are usually villages or sub-village settlements. For provinces with populations of 750,000 or higher, there is a two-tier municipal model. The upper tier is a metropolitan municipality with general authority, and the lower tier comprises district municipalities responsible for delivering public services of more local nature within the boundaries of the relevant metropolitan municipality. Special provincial administrations constitute another type of Turkish local government, each of which covers the entire territory of a province, is charged with delivering the services to municipalities and particularly to villages within the respective province as prescribed by laws. The last type of local government is a village which is tasked with meeting the common local needs of the people in the rural settlements that do not have a status of municipality.
1.2. Municipal organs consist of a municipal council as the decision-making body, a mayor as the executive body, and a municipal executive committee as the executive body advising and assisting the mayor. The mayor and all municipal councillors are elected by the votes of local people; one half of the members (3 members at municipalities with population above 100,000, and 2 for others) of the municipal executive committee other than the mayor who also presides over the committee is elected every year by the municipal council from among its members. The number of municipal councillors varies by the size of population residing within the respective municipal boundaries.

1.4. Organs of a special provincial administration consist of a general provincial council as the decision-making body, a governor as the executive body, and a provincial executive committee as the executive body advising and assisting the governor. 2. Candidacy
2.1. Those who are 25 years of age or above, have served in the military (required for men only), are graduates of at least primary school, and not convicted of prison sentences beyond certain terms for certain offences may stand as candidates for mayor or municipal councillor or general provincial councillor. There is no candidacy procedure for village master or membership in the village executive committee. Being literate is sufficient for standing for election for village master or membership in the village executive committee. Candidacy may be pursued either by inclusion in the list of a political party or by standing as an independent candidate.
2.2. The principles that apply to general elections for parliamentary deputies shall also apply to those public officials and managers of political parties who wish to stand as candidates. Accordingly, public officials, managers of political parties, and heads and members of provincial, district and town organizations of political parties who wish to stand as candidates must resign from office one month prior to the start of the election period. Those public officials who have resigned from office but been unable to become a candidate, or have become a candidate but not been able to be elected may return to their offices.
