Turkish to English: Translation of a Legal Regulation
Source text - Turkish İş Sağlığı ve Güvenliği Kanunu’nun amacı; işyerlerinde iş sağlığı ve güvenliğinin sağlanması ve mevcut sağlık ve güvenlik şartlarının iyileştirilmesi için işveren ve çalışanların görev, yetki, sorumluluk, hak ve yükümlülüklerini düzenlemektir.
Kanun; kamu ve özel sektöre ait bütün işlere ve işyerlerine, bu işyerlerinin işverenleri ile işveren vekillerine, çırak ve stajyerler de dâhil olmak üzere tüm çalışanlarına faaliyet konularına bakılmaksızın uygulanmaktadır.
Kanun aşağıda belirtilen faaliyetleri kapsam dışında tutmaktadır.
Fabrika, bakım merkezi, dikimevi ve benzeri işyerlerindekiler hariç Türk Silahlı Kuvvetleri, genel kolluk kuvvetleri ve Milli İstihbarat Teşkilatı Müsteşarlığının faaliyetleri.
Afet ve acil durum birimlerinin müdahale faaliyetleri.
Ev hizmetleri.
Çalışan istihdam etmeksizin kendi nam ve hesabına mal ve hizmet üretimi yapanlar.
Hükümlü ve tutuklulara yönelik infaz hizmetleri sırasında, iyileştirme kapsamında yapılan iş yurdu, eğitim, güvenlik ve meslek edindirme faaliyetleri.
Kanun, Avrupa Birliği 12 Haziran 1989 tarihli ve 89/391/EEC sayılı Konsey Direktifinin ulusal mevzuatımıza uyumlaştırılmasını ve iş sağlığı ve güvenliği ve çalışma ortamına ilişkin 155 Sayılı ve iş sağlığı hizmetlerine ilişkin 161 Sayılı ILO sözleşmelerinin iç hukuka yansıtılarak uygulanmasının sağlamaktadır.
Translation - English The aim of Occupational Health and Safety Law is to promote occupational health and safety in workplaces and to arrange the tasks, authorities, responsibilities, rights and obligations of both employers and employees in order to enhance the present health and safety conditions.
Law is enforced on each and every work and workplace in public and private sectors, on employers and employer agents of those workplaces, and on each and every employee including apprentices and interns regardless of his or her subject of activity.
Law excludes the activities stated below.
Activities of Turkish Armed Forces, general law-enforcement officers and Undersecretariat of National Intelligence Agency, except in such workplaces as factories, maintenance centers, sewing workshops, etc.
Intervention activities of disaster and emergency units.
Home delivery services.
Persons who produce goods and services in their names and accounts without employing any other persons.
Workplace, education, safety and career development activities performed as part of betterment during execution services to convicts and detainees.
The law enables both the Council Directive of 12 June 1989 89/391/EEC by the European Union to be adapted into our national legislation and ILO contracts 155 and 161 related to occupational health and safety and working conditions and related to occupational health services respectively to be put into force by projecting them onto domestic law.
English to Turkish: Labour Code
Source text - English The Labour Code states that the heads of establishment, senior managers, legal managers or their delegates can be prosecuted, if by their “personal fault” they have violated any of the safety obligations set out in the Code. In effect this means that either those designated as heads of establishment or those to whom
responsibilities have been delegated can be prosecuted.
It should be noted that although the section states that there should be some “personal fault” on the part of the head of the establishment or his/her delegates, French judges have interpreted this broadly and the head of the establishment can be held liable for failing to personally ensure that rules are being complied with.
His or her absence from the premises at the time of the incident is not considered a valid excuse as the courts have ruled that he should have delegated supervision in his or her absence.
Those convicted can be sentenced to a fine of €3,750, which can be multiplied by the number of employees affected by the breach. If the offence is repeated, the sanction will be doubled.
Translation - Turkish İş Kanunu’na göre işletme başkanı, üst düzey yöneticileri, yasal yöneticileri veya onların vekilleri hakkında, eğer kendi ‘kişisel hataları’ sebebiyle Kanun’da belirtilen güvenlik gereklerinin herhangi birini ihlal ederlerse, kovuşturma başlatılabilir. Uygulamada bu, işletme başkanları veya yükümlülüklerin tevkil edildiği kişilerin yargılanabileceği anlamına gelir.
İlgili bölümün, işletme başkanı veya vekillerinin az çok ‘kişisel hatasının’ bulunması gerektiğini belirtmesine rağmen Fransız hakimlerin bunu geniş bir şekilde yorumladığı ve işletme başkanının kurallara uyulduğunu kişisel olarak garanti etmede başarısız olmaktan sorumlu tutulabileceği göz önünde bulundurulmalıdır. Mahkemelerin önceki davalarda başkanın yokluğunda yerine bakacak denetçi tevkil etmiş olması gerektiğine dair karar verdiklerinden dolayı kaza esnasında olay mahallinde bulunmuyor olması geçerli bir mazeret olarak değerlendirilmez.
Suçlu bulunanlar 3750 Avro’luk bir para cezasına çarptırılabilir ve bu meblağ ihlalden etkilenen işçilerin sayısıyla çarpılabilir. Eğer suç tekerrür ederse, yaptırım iki katına çıkarılır.
