1. Sämtliche anzumietenden Flächen gemäß § 2 werden zum Zwecke des Betriebs einer Wirtschaftsprüfungs-, Steuer- und Unternehmensberatungsgesellschaft genutzt. Der Vermieter stimmt zu, dass Teile der Mietfläche von einer dem [Name]-Verbund angehörenden Rechtsanwaltsgesellschaft genutzt werden. Dem Mieter ist gestattet, im Mietobjekt an geeigneter Stelle und für den Eigenbedarf eine Cafeteria (keine Vollgastronomie) zu betreiben.
2. Dem Mieter ist die Untervermietung von (Teil-) Flächen an Dritte, die ihrerseits zur Umsatzsteuer optieren, mit Einwilligung des Vermieters gestattet, die dieser nur aus wichtigem Grund versagen darf. Solange und soweit die Finanzbehörde bezüglich des Begriffs der "ausschließlichen" Verwendung für Umsätze, die den Vorsteuerabzug nicht ausschließen, eine - auch von den Finanzgerichten anerkannte - unschädliche Bagatellgrenze anwendet, ist durch diese Bagatellgrenze zugleich der Aus-schließlichkeitsbegriff in der vorstehenden Bestimmung begrenzt.
